In April of 1917, Lewis & the family moved to Miles City, Montana.  He was later convicted of rape there and sentenced to prison.  Zeruiah and he were then divorced and she lived with her children until her death.  His conviction was documented in the newspaper on December 1, 1917 as:
  Cass Goes to Red Lodge
  Four criminal cases were considered by the court, the most important of which was the charge of rape
  against Lewis S. Cass. The case was an especially aggravating one and no reasonable excuse was
  produced by the defendant when called before the bar of justice. He endeavored to impress the court
  with the fact that he had no recollection of having committed the crime, which he claimed must have
  been due to the excessive heat of the summer and the further fact that he had  been greatly worried
  over business matters and was not responsible. He was sentenced to serve not less than 12 nor more
  than 30 years in the penitentiary.
